§ 4-24. Location of alcoholic beverage licenses.

  • (a)

    No new retail package liquor license for a business engaged in the retail package sales of distilled spirits shall be issued within 500 yards of any other business licensed to sell distilled spirits at retail, as measured by the most direct route of travel on the ground; provided however, this limitation shall not apply to any hotel licensed under this chapter. Further provided, that this restriction shall not apply at any location for which a retail distilled spirits license has been issued prior to July 1, 1997, nor to the renewal of such license.

    (b)

    No license shall be issued for the sale of distilled spirits, malt beverages, and wine in and within 100 yards of any church building.

    (c)

    No license shall be issued for the sale of any distilled spirits within 200 yards of any school building, educational building, school grounds or college campus.

    (d)

    No license shall be issued for the sale of any wine or malt beverages within 100 yards of any school building, educational building, school grounds or college campus.

    (e)

    No license shall be issued for the sale of any distilled spirits, wine or malt beverages within 100 yards of any alcoholic treatment center owned and operated by the state, county or city government therein.

    (f)

    The distances defined herein shall not apply to any location of an existing license, renewal of license, or issuance of new license in a previously licensed location.

    (g)

    Nothing contained in this section shall prohibit the licensing of the sale of alcoholic beverages by:

    (1)

    Hotels or motels which have been in continuous operation for a period of at least five years preceding December 15, 2014;

    (2)

    Bona fide private clubs, owning their own buildings.
