§ 4-23. Location of establishments near dwellings.

No new alcoholic beverage license shall be issued under this article for a location within 250 feet of a dwelling house without the written consent of the owner of same. This provision does not apply to any location which was licensed prior to January 1, 1984. This prohibition does not apply where a dwelling house was constructed or moved within 250 feet of a location with an existing license. For the purpose of this section, the term "dwelling house" shall include mobile or relocatable homes, duplexes and apartment buildings.
